5. Mose 21
1 Wenn man einen Erschlagenen findet in dem Lande, das dir der HERR, dein Gott, geben wird einzunehmen, und er liegt im Felde und man weiß nicht, wer ihn erschlagen hat, 2 so sollen deine Ältesten und Richter hinausgehen und von dem Erschlagenen messen bis an die Städte, die umher liegen. 3 Welche Stadt die nächste ist, deren Älteste sollen eine junge Kuh von den Rindern nehmen, mit der man nicht gearbeitet und die noch nicht am Joch gezogen hat, 4 und sollen sie hinabführen in einen kiesigen Grund, der weder bearbeitet noch besät ist, und daselbst im Grund ihr den Hals brechen. 5 Da sollen herzukommen die Priester, die Kinder Levi; denn der HERR, dein Gott, hat sie erwählt, daß sie ihm dienen und in seinem Namen segnen, und nach ihrem Mund sollen alle Sachen und alle Schäden gerichtet werden. 6 Und alle Ältesten der Stadt sollen herzutreten zu dem Erschlagenen und ihre Hände waschen über die junge Kuh, der im Grunde der Hals gebrochen ist, 7 und sollen antworten und sagen: Unsre Hände haben dies Blut nicht vergossen, so haben's auch unsre Augen nicht gesehen. 8 Sei gnädig deinem Volk Israel, das du, HERR, erlöst hast; lege nicht das unschuldige Blut auf dein Volk Israel! So werden sie über dem Blut versöhnt sein. 9 Also sollst du das unschuldige Blut von dir tun, daß du tust, was recht ist vor den Augen des HERRN.
10 Wenn du in einen Streit ziehst wider deine Feinde, und der HERR, dein Gott, gibt sie dir in deine Hände, daß du ihre Gefangenen wegführst, 11 und siehst unter den Gefangenen ein schönes Weib und hast Lust zu ihr, daß du sie zum Weibe nehmest, 12 so führe sie in dein Haus und laß sie ihr Haar abscheren und ihre Nägel beschneiden 13 und die Kleider ablegen, darin sie gefangen ist, und laß sie sitzen in deinem Hause und beweinen einen Monat lang ihren Vater und ihre Mutter; darnach gehe zu ihr und nimm sie zur Ehe und laß sie dein Weib sein. 14 Wenn du aber nicht mehr Lust zu ihr hast, so sollst du sie gehen lassen, wohin sie will, und nicht um Geld verkaufen noch versetzen, darum daß du sie gedemütigt hast.
15 Wenn jemand zwei Weiber hat, eine, die er liebhat, und eine, die er haßt, und sie ihm Kinder gebären, beide, die liebe und die unwerte, daß der Erstgeborene von der unwerten ist, 16 und die Zeit kommt, daß er seinen Kindern das Erbe austeile, so kann er nicht den Sohn der liebsten zum erstgeborenen Sohn machen für den erstgeborenen Sohn der unwerten, 17 sondern er soll den Sohn der unwerten für den ersten Sohn erkennen, daß er ihm zwiefältig gebe von allem, was vorhanden ist; denn derselbe ist der Erstling seiner Kraft, und der Erstgeburt Recht ist sein.
18 Wenn jemand einen eigenwilligen und ungehorsamen Sohn hat, der seines Vaters und seiner Mutter Stimme nicht gehorcht und, wenn sie ihn züchtigen, ihnen nicht gehorchen will, 19 so sollen ihn Vater und Mutter greifen und zu den Ältesten der Stadt führen und zu dem Tor des Orts, 20 und zu den Ältesten der Stadt sagen: Dieser unser Sohn ist eigenwillig und ungehorsam und gehorcht unsrer Stimme nicht und ist ein Schlemmer und ein Trunkenbold. 21 So sollen ihn steinigen alle Leute der Stadt, daß er sterbe, und sollst also das Böse von dir tun, daß es ganz Israel höre und sich fürchte.
22 Wenn jemand eine Sünde getan hat, die des Todes würdig ist, und wird getötet, und man hängt ihn an ein Holz, 23 so soll sein Leichnam nicht über Nacht an dem Holz bleiben, sondern du sollst ihn desselben Tages begraben, denn ein Gehenkter ist verflucht bei Gott, auf daß du dein Land nicht verunreinigst, das dir der HERR, dein Gott, gibt zum Erbe.
Deuteronomy 21
Laws Concerning Unsolved Murder
1 If a homicide victimt should be found lying in a field in the land the Lord your God is giving you,t and no one knows who killedt him,2 your elders and judges must go out and measure how far it is to the cities in the vicinity of the corpse.t3 Then the elders of the city nearest to the corpset must take from the herd a heifer that has not been worked – that has never pulled with the yoke –4 and bring the heifer down to a wadi with flowing water,t to a valley that is neither plowed nor sown.s There at the wadi they are to break the heifer’s neck.5 Then the Levitical priestst will approach (for the Lord your God has chosen them to serve him and to pronounce blessings in his name,t and to decidet every judicial verdictt)6 and all the elders of that city nearest the corpset must wash their hands over the heifer whose neck was broken in the valley.t7 Then they must proclaim, “Our hands have not spilled this blood, nor have wet witnessed the crime.t8 Do not blamet your people Israel whom you redeemed, O Lord, and do not hold them accountable for the bloodshed of an innocent person.”t Then atonement will be made for the bloodshed.
9 In this manner you will purge out the guilt of innocent blood from among you, for you must do what is right beforet the Lord.
Laws Concerning Wives
10 When you go out to do battle with your enemies and the Lord your God allows you to prevailt and you take prisoners,11 if you should see among themt an attractive woman whom you wish to take as a wife,12 you may bring her back to your house. She must shave her head,s trim her nails,13 discard the clothing she was wearing when captured,t and stayt in your house, lamenting for her father and mother for a full month. After that you may have sexual relationst with her and become her husband and she your wife.
14 If you are not pleased with her, then you must let her gos where she pleases. You cannot in any case sellt her;t you must not take advantage oft her, since you have already humiliateds her.
Laws Concerning Children
15 Suppose a man has two wives, one whom he loves more than the other,t and they botht bear him sons, with the firstborn being the child of the less loved wife.16 In the day he divides his inheritancet he must not appoint as firstborn the son of the favorite wife in place of the othert wife’s son who is actually the firstborn.
17 Rather, he must acknowledge the son of the less lovedt wife as firstborn and give him the double portiont of all he has, for that son is the beginning of his father’s procreative powert – to him should go the right of the firstborn.
18 If a person has a stubborn, rebellious son who pays no attention to his father or mother, and they discipline him to no avail,t19 his father and mother must seize him and bring him to the elders at the gate of his city.20 They must declare to the elderss of his city, “Our son is stubborn and rebellious and pays no attention to what we say – he is a glutton and drunkard.”
21 Then all the men of his city must stone him to death. In this way you will purge outt wickedness from among you, and all Israels will hear about it and be afraid.
Disposition of a Criminal’s Remains
22 If a person commits a sin punishable by death and is executed, and you hang the corpset on a tree,
23 his body must not remain all night on the tree; instead you must make certain you buryt him that same day, for the one who is left exposedt on a tree is cursed by God.s You must not defile your land which the Lord your God is giving you as an inheritance.
